Frequently asked questions

Short answers to the questions the office receives most.

Is the first consultation really free?

Yes. Send a short description of your matter on WhatsApp or call the office, and you will receive an initial assessment of your legal position at no charge. You then decide whether to appoint the office.

Where does a divorce case start in Kuwait?

Usually at the Family Dispute Settlement Centre attached to the Family Court. Article 9 of the Family Court Law No. 12 of 2015 does not admit divorce claims where reconciliation is possible before the settlement request is decided; settlement takes up to 15 days, extendable to 60 by agreement.

What is the difference between separation for harm and khul‘?

Separation for harm is a court judgment based on proof of harm (Article 126 of the Personal Status Law) and results in an irrevocable divorce. Khul‘ is a divorce against consideration agreed between the spouses (Article 111).

Can a wife ask for divorce without the husband’s consent?

Yes, in the cases set by law — including separation for harm (Article 126 onwards) and divorce for non-maintenance (Article 120). Each case depends on the facts and documents.

What should I do if I receive a summons or a criminal complaint?

Do not give any statement before the file is reviewed with a lawyer. Contact the office immediately; having counsel present from the first investigation protects your position.

What is the fastest way to collect a documented debt?

If the debt is in writing, for a fixed amount and due, a payment order is usually faster than an ordinary claim. A bounced cheque has both a criminal and a civil route. The office decides the route after reviewing your documents.

Does the office work with expatriates and non-Arabic speakers?

Yes. The office represents Kuwaitis and expatriates alike, and communicates in Arabic and English.
